Terms and Conditions

These Terms and Conditions (“Agreement”) govern all estimates, quotes, fencing installations, decks, remodeling, and residential construction services provided by Light Rock Construction (“we,” “us,” or “our”). By requesting an estimate, signing a contract/proposal, accessing our website, or engaging our services, you (“Client” or “Homeowner”) agree to be bound by the terms outlined below.

1. Scope of Services

Light Rock Construction provides residential fencing installation, fence replacement, fence repairs, custom gates, deck construction, bathroom remodeling, kitchen remodeling, custom tile, custom showers, and general residential construction throughout Lake Stevens, Snohomish County, and King County, Washington.

The specific scope of work, materials, dimensions, and deliverables are set forth in each client’s written estimate, signed contract, or change order. Any modifications, additional footage, hidden underground obstructions, rot repairs, or changes outside the written scope require a written change order and approved additional fees.

2. Estimates, Billing, and Payments

Estimates provided online or over the phone are preliminary and subject to an in-person site inspection and measurement verification. Project payments follow the schedule outlined in the written contract: typically a deposit upon signing/scheduling to secure materials, milestone progress payments for larger remodel projects, and the final balance upon substantial completion.

Custom materials (such as custom cedar gates, specialty tiles, or custom lumber orders) ordered once a deposit is made are non-refundable. Failure to remit payments in accordance with agreed contract milestones may result in work suspension until the account is brought current.

3. Client & Property Owner Responsibilities

The property owner is responsible for:

  • Clearly identifying and confirming property boundary lines and corners prior to fence layout
  • Ensuring clear physical access to the jobsite, driveways, water, and power sources during working hours
  • Securing pets and children away from active construction and excavation areas at all times
  • Notifying contractor of any private, non-public underground utilities (sprinklers, low-voltage landscape lighting, private electrical runs, pool lines, septic fields) not marked by 811 utility locators
  • Reviewing completed work promptly and communicating any questions prior to final sign-off

4. Underground Utilities & 811 Locates

For any excavation or post hole digging, public utility locates (Call Before You Dig / 811) are contacted as required by Washington State law. Light Rock Construction is not responsible for damage to unmarked private lines, irrigation, invisible dog fences, or secondary utilities not located through public 811 marking systems unless specifically mapped and provided in writing by the homeowner prior to digging.

5. Permits & HOA Compliance

Unless explicitly included in the written scope of work, homeowner is responsible for verifying neighborhood HOA covenants, setbacks, and height restrictions. When building permits are required by local jurisdictions (City of Lake Stevens, Snohomish County, etc.), permit fees and responsibilities will be specified in the project proposal.

6. Natural Materials & Weather Conditions

Cedar and natural wood products are subject to natural variations in grain, knotting, color, minor checking, and seasonal expansion or shrinkage caused by Pacific Northwest humidity and rain. These natural wood characteristics do not constitute defects in workmanship. We select quality materials and build to proven construction standards to minimize weather wear. Weather delays (such as torrential rain, freezing ground, or high wind) may necessitate schedule adjustments to preserve quality and jobsite safety.

7. Subcontractors and Specialized Trades

We may utilize vetted licensed subcontractors or trade specialists (such as licensed electrical or plumbing partners for remodeling work where code requires). Light Rock Construction oversees project management and standards of craftsmanship.

8. Workmanship Warranty

Light Rock Construction warrants its construction workmanship against defects for the warranty period specified in the project contract from the date of substantial completion. This warranty covers structural stability, post setting, gate hardware installation, framing, and tile workmanship under normal residential use.

The warranty does not cover damage resulting from severe storm/wind events, falling trees, soil erosion/landslides, customer misuse, vehicle impact, unauthorized modifications, or improper maintenance.

9. Dispute Resolution & Collections

Both parties agree to make reasonable good-faith efforts to resolve any dispute through direct communication. If an unpaid balance requires collection proceedings, Light Rock Construction reserves the right to pursue full payment of balances due along with associated administrative costs, statutory interest, and reasonable attorney fees as permitted under Washington law.

10. Communications & SMS Consent

By submitting an estimate form or engaging our services, you consent to receive project-related communications via phone, email, and SMS text message regarding your estimate, site walk, material delivery, project scheduling, and invoices.

Message frequency varies. Standard message and data rates may apply. You may opt out of SMS messages at any time by replying STOP. Reply HELP for assistance.

We do not sell or share contact details for third-party advertising.

11. Data Privacy & Confidentiality

Customer personal and project details are collected, stored, and processed in accordance with our Privacy Policy. We do not sell your personal data to marketing lists or third parties.

12. Limitation of Liability

To the maximum extent permitted under Washington State law, Light Rock Construction’s liability arising out of or related to any project or agreement shall not exceed the total contract price actually paid by the client for the specific work in question. In no event will either party be liable for indirect, incidental, or consequential damages.

13. Governing Law

This Agreement and all contracts shall be governed by and construed in accordance with the laws of the State of Washington, with venue in Snohomish County, Washington.

14. Modifications

We reserve the right to update these terms at any time. The most current version will be posted on our website.
